The Gonzales House
The benchmark case law for this ruling was determined by the 'Gonzales House' case. This house had a tainted history in which a murder had occurred in the property. This ‘material fact’ was not disclosed during the sale process by the agent. There was a lack of disclosure by the agent to the prospective purchaser.
